			<content:encoded><![CDATA[<p>In 2008, products that contain lead continue to arrive from China and appear everyday on American store shelves. The purchase of many of these products can result in a variety of potential health risks to the unsuspecting consumer. The danger inherent in the lead in the product is not identified on the product label. The consumer has no knowledge until a product is recalled that the product even contained lead.</p>
<p>Last year in America there was an extensive list of consumer products, made in China, that were recalled. The 2007 product recall list for high lead content included the following items: jackets and overalls, bracelets, key chains, children&#8217;s rings, easels, paint, lunch boxes, necklaces, and wooden toys.</p>
<p>In 2008, imported products containing high lead content continue to be found on store shelves. So far this year the Consumer Product Safety Commission (CPSC) product recall list includes Hobby Stores Easter egg containers, X Force Commander Jet Airplanes (sold at the Dollar Store), children&#8217;s medal jewelry sold by the Pecoware Company, children&#8217;s memory testing cards from Riverside Publishing, children&#8217;s sketchbooks from eeBoo Corp, and various children&#8217;s educational products from importer RR Donnelley, of Chicago, Ill. The product recall list also includes products with high lead content in various children&#8217;s garden rakes, toy banks, and jewelry. In fact, at this point everything on the retail store shelf made in China, even if it has not yet been recalled, is an item that the consumer should assume probably contains lead.</p>
<p>In addition to products containing lead on the store shelves, a new concern for the consumer has surfaced in the dentist office. It has recently been reported that dental crowns, veneers, bridges, and dentures made in China and other foreign dental labs may contain lead. Since about 20% of restorative dental products are outsourced to foreign dental labs, including China, it may be a good idea for consumers to check with dentists to insure that their restorative dental care does not include dangerous amounts of toxic lead from products produced in foreign labs. The FDA currently monitors only a small amount of imported dental products for compliance to its standards.</p>
<p>The problem for the American consumer is that government agencies involved in product oversight have not been properly funded by the federal government. Indeed, the Consumer Product Safety Commission was created in 1974 to insure product safety for the American consumer. However, since its creation, imported products from China into the United States have increased over 300%, but the budget for the CPSC has been slashed to less than half of its original 1974 budgeted amount.</p>
<p>Consider that the CPSC began with 800 employees in 1974. Today, it only has 420 staff members with just one employee monitoring imported toys. It is an agency overwhelmed and therefore the American consumer should not expect it to protect them from all the  lead products on American store shelves imported from China. It is evident that many current products containing a high content of lead on American store shelves will never be properly identified or recalled.</p>
<p>The truth is that the world of globalization is presenting increased risk to the American consumer and the natural environment as it provides ever higher profit margins for large national and multi-national corporations. In an effort to increase profit margins by taking advantage of cheap, unskilled labor, an American company contracts China to make a product. This action reduces the cost of making the product to the company and, in effect, may out-source American jobs to mainland China. The product is made by the Chinese and imported back into the country where it is sold on American store shelves. The product is often made with cheap components such as lead paint. The imported product may not be reviewed by the CPSC because the Commission has not been properly staffed. Therefore the product may never be found to contain a high content of lead or ever be recalled.</p>
<p>If a product is discovered with lead, the product is then recalled by the company and apparently the lead somehow just disappears. Hopefully, in the next few years lead won&#8217;t be found in our landfills and contaminate the environment. On the other hand, if the product is not discovered to contain lead, but does, it is never recalled. It eventually gets sold to a consumer and the lead content in the item places the buyer&#8217;s health at risk. When the product is eventually discarded, it will end up in a landfill and the lead will contaminate the environment.</p>
<p>In an effort to finally address the problem, the United States House and Senate have both recently passed consumer protection bills. The Senate bill nearly doubles the budget of the Consumer Product Safety Commission from $88 million next year to close to $160 million in 2015. It bans lead in all but trace amounts in children&#8217;s toys, and it also gives the agency new authority to levy stiff fines against companies that balk at product recalls.</p>
<p>In effect, federal lawmakers have just begun to take the problem of imported lead on consumer products seriously. The new 2008 Consumer Protection Bill also bans lead on children&#8217;s toys. That sounds like a great idea until we realize that lead paint has been banned on children&#8217;s toys in the United States since 1978.</p>
<p>The solution to faulty consumer products is not politics, new law, or regulation. It is simply providing the money and the authority necessary for the CPSC to do the job it is supposed to do in an age of high consumer product imports and globalization. The federal government spends more than $400 billion per year in grants. In addition, Congressional pork-barrel spending was estimated to be $29 billion in the fiscal year 2006 alone. (Citizens Against Government Waste). A few million dollars to address the problem of lead in imported consumer products has always been available. It is about time that Congress has acted to provide the money necessary to begin to adequately staff the Consumer Product Safety Commission. Indeed, it is Congressional action long overdue to protect the American consumer and the environment from dangerous imported consumer products that contain high levels of lead.</p>

Consumer behavior is &#8216; the mental and emotional processes and the observable behavior of consumers during searching purchasing and post consumption of a product and service(Batra &amp; Kazmi, 2004) . Similarly Engel (et al, 1990) refers consumer behavior as the action and decision process of people who purchase goods and services for personal consumption.</p>
<p>Now if these defining criteria are closely observed, it is evident that analyzing consumer&#8217;s decision making process is the foundation of entire notion of consumer behavior</p>
<p>There are four different views related to consumer decision making process and behavior (Schiffman &amp; Kanuk, 2004). It is argued that first of them is &#8216;economic view&#8217; that consumers are primarily facing imperfect competition and they are always expected to make rational decision on the basis of assumptions that they are aware of all product alternatives, they can rank benefits and limitation of each alternative and are able to identify one best alternative. Second &#8216;Passive View&#8217; is absolutely opposite to economic view and suggests that consumers are irrational and impulsive as they are submissive to self-centered interests of marketers and got influenced by marketing tools. Similarly third, &#8216; Emotional View&#8217; is related to perceive consumer&#8217;s decision making based on their emotional association or feeling about some products and services. For instance, a person loosing red color specific pen neither go for rational decision by evaluating alternatives ( economic view) nor will the person get influenced by marketers ( passive view). Rather the person will try to purchase any pen closely resembled with his favorite possession. Fourth and arguably most acknowledged view is &#8216;Cognitive View&#8217; where consumers are considered as &#8220;thinking problem solver&#8217; which are receptive as well as actively searching for the products and services that can fulfill their need. Consumer&#8217;s behavior under this view is based on information seeking and processing attributes usually directed by a goal. For instance, buying a tooth paste from shop can have a certain goal of choosing product that can taste good (Papers4you.com, 2006).</p>
<p>Despite of critiques for each viewpoint, it can be considered a valid argument, that all four types of decision making behavior exist and provide marketer guidelines to analyze consumer accordingly.</p>
<p>Based on general perception about most acknowledged and common &#8216;cognitive view&#8217;, Batra &amp; Kazmi (2004) asserts broader stages of a consumer&#8217;s decision making process that includes problem identification (feeling need of a new car), information search ( on internet and showrooms), evaluation of alternatives (comparing brands, for instance&#8217; on basis of repute and features), outlet selection and purchase ( purchasing selected item) and post-purchase action (satisfaction or dissonance).</p>
<p>The discussion may be concluded on the notion that no matter which view point out of four discussed above is common; it is an imperative fact that marketers have to realize existence of all of them to analyze consumer behavior effectively.</p>

			<content:encoded><![CDATA[<p>There is no doubt that there is a great antagonism against consumer culture on the part of all Leftists, Socialists, Libertarians, Communists, and Anarchists &#8212; in short, every group that can be called a class of reformer or revolutionary.  Our reasoning is simple: there are things in life that have more value, meaning, and purpose than the manufactured products of a lifeless and mechanized society.  Those of us who are convinced of this truth thoroughly enough will do what we can to escape the tyranny that is produced in the corporate-dominated, consumer culture.  Many have escaped to the bosom of nature, taking a Thoreau-like approach to the question of &#8220;how should we live life?&#8221;  Some have adopted an extremely open and loving sexuality as a means achieving fulfillment in a world that&#8217;s too afraid to trust good will.  Others have traveled the path of the old psychedelic guru, ingesting mind-altering chemicals as though they were the nutrients necessary for a fully developed and mentally healthy psychology.  We are the artists who spit on artist organizations, the writers who mastermind brilliant ways to break grammar rules, the intoxicated friend at a party who admits what everyone is too afraid to say, the bombers of dams and the conceivers of boycotts; we are everything short of a complete and total revolution.  There&#8217;s a rag-tag, unregimented army of rebels, who are willing to spend their lives proving that absence of consumer culture doesn&#8217;t mean absence of all culture.  The development of real culture is only possible when the individual challenges their environment and makes demands on themselves to find the absolute and unadulterated truth &#8212; that is, real cultural revolution is only possible when the individual doubts what they are told.</p>
<p>A fair definition of Consumer Culture would be: relying on the owners of industry to produce for the people the main subject of their lives, that is, producing a culture for the people that revolves around consuming the products of this economy.  The difficulty that many people have with this is that the interests of the ruling class are not quite the same as those of the ruled class.  Corporations, such as Starbucks, WalMart, Nike, Adidas, Macintosh, and Shell, all manufacture their products in countries that exploit the working class.  Many of the workers labor twelve to sixteen hour days in dirty, unclean factories, under threat of a violent military regime or the agonizing poverty created by Capitalist, Free Trade, and embargo policies of the United States and other nations.  To trust those who created such a global calamity would be a great mistake.  Trusting them to create culture for us, to create something beautiful, unique, and personally challenging to fill our lives &#8212; to trust them to complete this task is only to make ourselves the slaves to their media.  What concentrated economic powers have done to satisfy their interests has already been demonstrated.  To trust them to make for us the meaning of life would just mean that we&#8217;re subjecting ourselves to the mental shackles they so desperately wish to put on us.  The message they give to you dominates conversations, thoughts, secret dreams, and painful aspirations.  Social control is established in this means by Consumer Culture.</p>
<p>One of the prime indicators of Consumer Culture is television.  Mega-corporations fight with each other over the will of the people, by developing newer and more captivating advertisements, by dumbing down plot lines for television shows so they capture more viewers, special interests get their views in and the public just follows along.  That is why television has become the daemon in the nightmares of every Freethinker.  The History Channel, which is hosted by an American corporation, rarely displays the United States government in any negative light.  The show Cops never shows a police officer failing to capture his victim.  The plot lines for most sitcoms revolve around things like money, romance, popularity, and other themes that easily capture attention but always fail to plant something meaningful.  Television programming has gone so far as to place advertisements as a part of the plot.  Here, in the living room of every family, there rests a machine that is constantly feeding ideas to a listening audience.  The plot lines, the themes, the ideals, the suggestions, hidden implications and subliminal advertising, all of it is to create a grasp of the way people think and act.  By their means of massive distribution, the media has molded the opinions of billions of people.  And who is it that holds the keys to this uninterrupted stream of suggestions to the public?  It is anyone who has the money.  That is the sole requirement that is necessary to reaching the minds of the public: who possesses the wealth.</p>
<p>Consumer Culture will naturally incite a feeling of loathing and disgust when investigated by any independent thinker.  Moreover than its innate failure to produce meaning or purpose beyond our immediate atmosphere, it is a detriment to something else: progressive change.  This phrase progressive change is a very general term, meaning when society reforms, revolves, or adaptates to a new condition that is more beneficial to civilization.  While every person is always in a state of perpetual evolution, sometimes steering towards good, sometimes falling towards bad, always in flux &#8212; while we are always changing and progressing through life, the term progressive change here indicates a change in our customs, our laws, our culture, our ideals, our way of life, as it pertains to us collectively.  It is a matter of interrelation.  By indicating to my brothers and sisters what I believe should be the order by which we adhere to collectively, I am making a position on the matter of social progress.  How can we change the ways we interact in a way that increases our benefits of working together in a mutual and cooperative environment?  That is what progressive change means.</p>
<p>Why Consumer Culture would be viewed by progressive revolutionaries as a threat is obvious.  By directing the attention and the awareness of the public on a lifestyle that requires playing by the rules of the system, social and political change stagnates.  The thoughts and ideas of the people in this society are focused on the issues that the corporations want them to be focused on.  Profit is the sole interest of those broadcasting the message of Consumer Culture; so one can only truly expect to see a constant barrage of suggestions and implications on how to behave, what to buy, how to treat other people, who to admire, and what to believe on the matter of government, economy, society, and culture.  All of these will be profit-driven.  What is the message that it brings?  It demands that people consume: a big car means that it&#8217;s easier to sleep at night, a stylish jacket will attract the attention of the opposite sex, absolute true love is only one phone call away, you can make a million in three and a half days by following this seven-step plan, peace of mind can be obtained with four easy payments, consume, consume, consume.</p>
<p>The immediate interest of a true consumer, then, is a self-interest that can only be satisfied by the products of this corporate mechanism.  It is true that greed has become nature&#8217;s way ever since the dawn of the idea of property.  But our corporate system has greatly refined humanity&#8217;s taste for elegance, luxury, and pleasure.  In the Capitalist system, a person can get just about anything they want, so long as their pockets run deep enough.  Such wonderful and pleasant schemes befall sleeping minds.  The individual&#8217;s interests then are focused on getting the wealth necessary to satisfy their consumption; they will be more willing to steal, to take advantage of the misfortune of others, to befriend and betray, to manipulate and deceive, to exploit the good will of another for wealth.  All consumers serve this social order as employees and workers.  They all trade their hours and their strength to labor in exchange for the wealth necessary to keep up their lifestyle.  Consumer Culture&#8217;s effect then is to create division and disorder among the public, to let their blood and drain their strength.  And its secondary effect is to make it a goal for us to serve the financial dominion with our employment.</p>
<p>Consumer Culture is bent on the competitive spirit.  It asks that people throw their strength and energy against each other in order to achieve and accomplish.  By seeking their satisfaction through the goods and services of their corporate overseers, the first goal will be to accumulate money to procure these substances.  The impulse of greed becomes second nature.  The person is always either engaged in some manipulation of their comrades or constantly under suspicion of the intentions of their siblings.  Targets of property crime generally tend not to be the most wealthy.  Those who steal from their fellow humans tend to be just as poor as their victims.  Consumer culture has tempted daemons, and they are coming out.  This system of free enterprise only asks individuals to seek and benefit from the misfortune of others.  In a negotiation, if the individual with the strongest need is usually at the whim of the other&#8217;s mercy.  In a situation where someone has a strong enough need, they will enter into an agreement regardless of the terms; this, in effect, creates a slavery of one in favor of the other.  So it has become the will and the nature of our Capitalist society to seek the misfortune of others.</p>
<p>To make others need you so that you can satisfy your own self-interest at their slavery.  That was the original idea of Capitalism.  It was practiced by the coal barons who shut down their mines just to create an artificial winter in the cities, making the price go up along with profits.  It was an idea expanded upon by all of the companies that worked to dominate their industry, gnashing against each other in the competitive field of business.  And in its final state, this idea produces a way of life for people where they need the corporate product to satisfy their sense of meaning.  This is the way our social order has been organized since the existence of property.  But only with the emergence of Consumer Culture has it become so cutthroat in its tendency.  Everyone is praying for the misfortune of others, only so that the newly arising need of others would be the stepping stone to their wealth.  In such a world, all men and women are constantly seeking to exploit each other, never willing to trust, totally afraid to share, and certainly terrified of the idea of putting energy, will, and strength towards a collective effort.</p>
<p>The first effect of Consumer Culture is apparent: it creates a lust for worldly possessions that makes individuals hurt each other.  Beyond this, it asks that, in order to satisfy the interest of the corporate product, we must exchange our labor and time.  Our desire for the products of these corporations was manufactured by the marketing and advertising industry, feeling that it could create a sense of willingness to trust, desire, and protect the corporate world and its relationship to us &#8212; that is, Consumer Culture.  In the United States, we labor forty hours a week to earn the money necessary to satisfy these wants.  A workday will consist of one to two hours preparation before work, to put on our uniform and eat.  Public transit could take up to an hour to get you to where you work.  Eight hours fly by.  Another hour to get home.  Twelve hours of the working class, blue-collar laborer are spent just for an eight hour payday.  The modern inconveniences leave us with three hours to ourselves before we dive in to unconsciousness like we were dying.  So much is sacrificed; we lose so much of our time, our energy and our strength in this mad rush to serve the corporate interest.  Millions of people are in debt, because their working lifestyle spoiled their patience and turned them in to mindless animals seeking to cure their pain &#8212; to cure it with the corporate product.</p>
<p>The debt consolidation industry continues to reap its profits as payday loan stores pop up alongside funeral parlors and pawn shops in the ghettos.  It has always been the intention of the lords of industry to make the people need them &#8212; to force them into a situation where they would agree to the terms of any contract.  Consumer Culture is simply the sophistication of this method.  By controlling all forms of media and all information, corporations are capable of gaining more social control; and this is accomplished by making the people need the system more, by changing their attitudes.  With all of our time and efforts sacrificed to this monolithic beast, we have few moments to ourselves.  Those few moments are spent trying to kill the pain that came with this type of lifestyle.  We don&#8217;t read old books about philosophy and political theory.  We don&#8217;t admire the ideas of Locke, Machiavelli, and Bentham, nor do we appreciate the poetry of Shelley, the prose of Thoreau, or the written word of Paine.  Consumer Culture has buried the working public and it has left them with no way to get out and no chance to plan or plot for their escape.  When people are put into these type of oppressive situations, where so much must be given to live, where so many sacrifices are made to appease our constant inner turmoil, in this type of world situation, people will be bitter, cynical, and hopeless.  They will turn against each other with ferocity, sometimes to seek out vengeance or mastermind an exploitation; after living in this type of conditioned society, we seek to lessen our pain by causing the same misery on others.  And anyone who is capable of surviving without making the same sacrifices as us is instantly detested and hated, as though we were xenophobic to outsiders.</p>
<p>Can you imagine trying to develop a revolutionary and progressive movement in this type of atmosphere in Consumer Culture?  If you asked your coworker to unionize with you, they might tell you that they can&#8217;t afford to go on strike because they&#8217;re still making payments on their new car.  Or they might have no idea what the principle of solidarity means, or what a true working class ethic might entail.  Eleven to twelve hours of their day is spent in either preparing or going to work or actually laboring.  What&#8217;s left over isn&#8217;t spent in intensive thought on social issues or matters of political justice.  The other three to four hours left over is used in a mad rush by the citizen to alleviate the pain that was built up over the day.  It&#8217;s the kind of pain that comes from doing thousands of mindless, repetitive tasks in a single day.  The kind of misery that boils from supervisors and managers treating demanding obedience and respect constantly.  It is the stress from customer service jobs and bruises that come from physical labor employment.  When work ends, people run from their place of employment, seeking refuge in some escapist, fantasy-inducing activity.  The next three to four hours used to help them forget what was necessary to get to this point of the day.  Drug addictions become favorite pastimes in this type of environment.  By teaching people to need and satisfy their needs, Corporate Culture turns people into self-destructive zombies who serve the interest of the wealthy class.</p>
<p>Like a person inflicted with a burn wound, the employee released from his labor in capitalism seeks to relieve his pain immediately and quickly.  And the only cure for the suffering caused in this life is constantly advertised, on television, radio, buses, billboards, and a million other places where billions of eyes will be watching.  They cause our pains and then are quick to profit off of our headful of suffering.  To so control the lives of the common people, by forcing them into eight-hour daily slavery, by dominating their media with a pro-consumption message, by manufacturing these conditions that put chains on the wrists of every person &#8212; this is real tyranny.  Capitalism can produce nothing else, and this Consumer Culture is just the most refined and sophisticated form of wage-slavery in any post-industrial part of the world.</p>
<p>They ask us to seek satisfaction in cooperation with each other in order to secure their interests.  That is the principle effect of Consumer Culture.  As Libertarian-Communists, Anarcho-Syndicalists, and Revolutionary Socialists, whatever name we decide to call ourselves, we must oppose Consumer Culture, and any other chains that the oppressors attempt to put on us and our fellows.</p>

<p>&#8220;Internet buyers tend to be better informed on market conditions and better prepared to act on the home they want when they start working with a realtor. Luckily for realtors, these changes don&#8217;t necessarily hurt, as long as they are able to adjust to the new relationship and realize that the new-style buyers value speed and efficiency over guidance when finding a home.&#8221;</p>
<p>- E-marketer, Internet Home Buyers Changing the House Rules</p>
<p>Thanks to the Internet and other technological innovations, more real estate information is freely available than ever before. As a result, consumers are demanding new choices, improved services, faster transactions and lower prices. According to a recent NAR survey, the number of sellers stating that they didn&#8217;t want to pay a sales commission fee rose from 46 percent in 2003 to 61 percent in 2004. In 2004, 23 percent of Florida home sellers opted to sell independently without an agent, up from 14 percent in 2003 and nearly double the 14 percent national average, according to Planet Realtor.</p>
<p>And Web-enabled consumers are demanding a high digital IQ when working with real estate professionals. In addition to being well-versed on their own industry-specific technology, real estate professionals now are expected to utilize laptops, mobile phones, digital cameras, personal digital assistants and global positioning systems to keep pace with Internet buyers and sellers.</p>
<p>Downward pressure</p>
<p>&#8220;If consumers are going to do their own home-shopping online, they expect to save some money, just as they would for using the self-service lane. That&#8217;s why they are susceptible to online discount brokers and the new affinity companies that are promoting lower commissions if only the consumers will use their agents. These business models promote the idea to consumers that they ought to be paying less money in commissions.&#8221;</p>

<p>Traditional real estate commissions, typically around six percent of a home&#8217;s selling price, are facing downward pressure from consumers and competition. Some consumers claim traditional real estate commissions don&#8217;t reflect:</p>
<p>- Today&#8217;s home prices. Years ago, when median-priced homes sold for $25,000, real estate commissions were typically five percent, or $1,250. Today, with South Florida median home prices around $300,000, the cost of a six percent full-service real estate commission becomes $18,000. Some brokers even charge additional fees to cover administrative costs. When you consider that today&#8217;s average homeowner sells a home every five to seven years, real estate commissions can dramatically impact your personal savings and net worth.</p>
<p>- Owner equity. When selling properties, most homeowners calculate the cost of selling as a portion of sales price, though the commissions are paid out of owner equity. (Equity is the difference between the value of your property and amount of mortgages owed.) Consider this example: You decide to sell a property for $250,000 in which you hold 10 percent equity, or $25,000. After paying a six percent commission of $15,000, you are left with $10,000 before any applicable closing costs. In this example, the $15,000 commission is six percent of the selling price, but 60 percent of the $25,000 equity.</p>
<p>- Services performed. Under today&#8217;s commission structure, selling a $100,000 house at six percent typically costs $6,000, while selling a $500,000 house costs $30,000. Does selling the more expensive home really require five times more effort? Your cost is the same whether the agent spends one hour or 100 hours marketing your home. This is one reason many real estate consumers find fee-for-service real estate so appealing. <br />Developing alternatives</p>
<p>&#8220;Consumers want what they want, when they want it and will gravitate to the most cost-effective source to obtain it.  Why?  Because our &#8220;one-size-fits-all&#8221; approach to working with sellers and buyers is archaic and won&#8217;t allow consumers to access various segments of help they need in a timely fashion.  That&#8217;s why .com Web start-ups are finding a receptive audience in real estate consumers and why for-sale-by-owners are burgeoning.&#8221;</p>

<p>Until recently, you have had few practical alternatives to the traditional full-service, full-commission real estate transaction with a broker. Most sellers paid a single commission fee for a full range of real estate services, whether they needed them or not. Now traditional real estate agencies face the challenge of identifying new services that have value to today&#8217;s sophisticated online and empowered consumers.</p>
<p>One result is an &#8220;unbundling&#8221; of traditional one-size-fits-all real estate services for consumers who want more control over real estate transactions and their associated costs. If you&#8217;re willing to take on some tasks traditionally performed by agents and brokers, you could receive lower transaction costs. You might benefit from the following emerging alternatives:</p>

Many traditional real estate brokerages are beginning to offer a more menu-based service plan. For example, you may not mind listing your home and holding open houses, but you may want assistance with contracts and closings.</p>
<p>One-stop shopping</p>
<p>In response to dwindling margins and the rising costs of technology and lead generation, some real estate companies are attempting to combine traditional and Web-based services to provide consumers a single source for all their real estate needs. One-stop shopping sites generally provide or partner with lenders, insurers, title companies, real estate attorneys and others to facilitate all aspects of buying and selling. In addition, some sites are adding home-improvement and related services to stay in touch with consumers between buying and selling transactions.</p>
<p>Web-based discounters</p>
<p>Although many Web-based real estate companies flamed out in the dotcom era, scores of new companies have emerged to take their place. By offering targeted services such as flat-fee MLS listings, buyer rebates and AVM tools, these sites are appealing to independent buyers and sellers who prefer to take a more active role in transactions. In addition to listings, some sites also offer how-to articles and advice for those who choose to go it alone. <br />Tradition + technology + turbulence = opportunities</p>
<p>So, given the trends, changes and ongoing industry evolution, what can independent buyers, sellers and investors expect in this new era of real estate?</p>
<p>o The Web and other technologies will continue to evolve and transform the $1.3 trillion real-estate industry. Technology will continue to reduce the time, expense and complexity of manual processes, and increasingly sophisticated search and valuation tools will play a more strategic role.</p>
<p>o Free and low-cost real estate resources will continue to be available and even multiply on the Web. In real estate, knowledge truly is power. Consumers will try to use their power to gain more control of the real estate process and subsequently expect to be compensated in the form of reduced and fee-for-service commissions.</p>
<p>o The role of traditional real estate brokerages will evolve as Web-enabled consumers become more knowledgeable. This likely will trigger some restructuring and consolidation of traditional brokerages, but will also drive the development of innovative new practices targeting online and empowered consumers. Real estate professionals will focus more on promoting their local knowledge and industry expertise, while consumers will perform some buying and selling tasks on their own.</p>
<p>o Traditional real estate commissions and profitability levels will continue to face downward pressure from various sources. The future will be profitable for brokerages that are able to extend their core expertise of neighborhood and industry knowledge into flexible new consumer-centric offerings.</p>
<p>o The traditional high-touch, full-service real estate agency is evolving, not disappearing. Real estate professionals who provide exceptional service and value to their customers will always be in demand.</p>
<p>You now can find more real estate knowledge, tools and resources on the Web than ever before, enabling you to buy and sell with increased confidence. For real estate professionals, reinventing the industry means making hard decisions, changing processes and managing new opportunities. But for consumers, reinvention in real estate is a winner, hands-down.</p>

The Union has in fact incorporated, as the basis of its consumer policy, the protection of the five fundamental rights which lie at the heart of national policies. These are:</p>
<p>1. The protection of consumers&#8217; health and safety</p>
<p>Only products which will not endanger health or safety may be put on the market. This means setting safety requirements, providing full information about potential risks, and protecting consumers against physical injury.</p>
<p>2. The protection of consumers&#8217; economic interests</p>
<p>There is for example a general ban on misleading advertising and unfair terms in contracts with consumers.</p>
<p>3. Consumer rights to information and education</p>
<p>Consumers need to be put in a position where they can make an informed choice among goods and services offered. This includes objective information on the features and price of the items available. Consumers also require proper information about their efficient and safe use.</p>
<p>4. The right to redress</p>
<p>Consumers have the right to receive advice and help when seeking redress for faulty products or for injury or damage resulting from the use of goods and services. There need to be simple, affordable and rapid procedures for settling complaints and claims.</p>
<p>5. Consumer representation and participation</p>
<p>Representatives of consumers need to be present in decision-taking procedures on issues of concern to them at local, national or EU level. At Union level, this covers not only specific consumer issues but also other relevant policy areas like food laws, transport, competition policy, financial services, and environment.</p>
<p>When the Community (the former name of the European Union) adopted its first consumer program in 1975, it focused on the practical application of the five principles. The first result was a number of directives which were adopted over the next 10 years covering among other things the safety of cosmetic products, the labeling of foodstuff, misleading advertising, consumer rights in door-step selling, product liability and the provision of consumer credit. In addition to its program of legislation on consumer protection, the Union took steps to make sure the interests of consumers are taken into account at local and EU level. It has supported the development of national consumer organizations and five major EU-wide organizations with consumer interests.</p>

<p>- The European Consumer&#8217;s Organization (BEUC),</p>
<p>- The Confederation of Family Organizations in the European Union (Coface),</p>
<p>- The European Community of Consumer Cooperatives (Eurocoop),</p>
<p>- The European Trade Union Confederation (ETUC),</p>
<p>- And The European Interregional Institute for Consumer Affairs (EIICA)</p>
<p>Internally, the European Commission created an independent Consumer Policy Service in 1989 in order to give more authority and a higher profile to the implementation of consumer policy.</p>
<p>According to the data of 1991, nearly 64% of Community GDP is devoted to private consumption, the highest proportion being 70.3% in Greece and the lowest</p>
<p>52.5% in Denmark (63.4% in UK). The remainder of the GDP is devoted mainly to financing investments and the collective consumption of general government.</p>
<p>On average, Europeans devote 20% of their &#8216;consumption&#8217; budget to food (ranging from 37.8% in Greece to 16.6% in Germany, 21.5% in the UK) whereas 17.2% covers housing expenditure (27.8% in Denmark as against 10.3% in Portugal, 18.5% in the UK). There are also marked disparities in spending on leisure and education (4.3% in Luxembourg compared with 10.5% in Ireland, with a UK average of 9.7%).</p>
<p>There is plenty to be done, even after the legislative program set out in the Maastricht Treaty on European Union is completed. The single market, like any other, needs to balance the interests of buyers and sellers if it is to operate efficiently. This means not only fixing additional rules for consumer protection but also ensuring that existing ones are applied correctly (which is not always the case).</p>

It is primarily used by lenders and creditors to determine your credit reputation or credit worthiness when deciding to extend you credit or grant you a loan. Although numerous smaller credit reporting agencies (CRAs) exist, there are only three major credit reporting agencies (CRAs) that are widely accepted; TransUnion, Equifax, and Experian. The consumer credit report is separated into a few major categories with the most common being Credit History, Public Records, Collection Accounts, Inquiries, and Personal Information.</p>
<p>The Credit History section displays some of the most common information that you would expect to see on a consumer credit report such as real estate mortgages, credit cards, lines of credit, personal loans, and auto loans. While displaying some of the most common information that you might expect to see such as the account name and account number of each account, this section of the consumer credit report also displays the status of each account and whether it is current or past due in payment. This section of the consumer credit report goes into further detail by displaying the balance, minimum payment due, and payment history of each account.</p>
<p>The Collection Account section of the consumer credit report displays information on accounts that have been charged off by the creditor and sent to collection agencies. The collection name and collection number should be exhibited along with the original creditor&#8217;s information. It should also exhibit the date in which the account was charged-off and sent to collection along with the dollar figure the collection agency is seeking to recover.</p>
<p>The Public Records section of the consumer credit report is reserved for county and state court records &#038; displays such items as foreclosures, bankruptcies, judgments, and tax liens. While numerous consumers do not have items that fall into this category, it is not uncommon for this section to be missing from the consumer credit report. Foreclosures, judgments, bankruptcies, and tax liens/civil liens are considered to be some of the most derogatory items that can be found on a consumer credit report. They have a very serious negative impact on the consumers credit score and a tremendous influence on a creditors or lenders decision to issue credit or grant a loan.</p>
<p>The Personal Information section of the consumer credit report consists of numerous items such as your full name, current and previous addresses, any known aliases, social security number, year of birth, current &#038; past employers. If available and available, this section will also exhibit similar information about your spouse.</p>
<p>As some of the terms used in this article may be unfamiliar to you, I have listed numerous terms and their corresponding definition below in order to help you understand the common consumer credit report.</p>
<p><b>Credit Report:</b> A complex report containing the credit history of a consumer. <p><b>Credit Reporting Agency:</b> Credit reporting agencies, often referred to as credit bureaus, are companies that collect, manage, and report information received from creditors and collection agencies regarding the individual consumer. The three largest and most commonly known credit reporting agencies are: TransUnion, Equifax, and Experian. Many consumers believe these companies to be official government entities, which is a common misconception. In fact, they are for-profit companies.</p>
<p><b>Collection Account:</b> A debt that is considered to be a loss or expense by the creditor. The creditor will attempt collecting that debt through the use of an internal collection department, outsource the account to a contracted collection agency, or sell the debt to a third party for a reduced price.</p>
<p><b>Chapter 7 Bankruptcy:</b> The most common form of consumer bankruptcy, Chapter 7 Bankruptcy typically releases a debtor from any and all liability for the credit accounts included in a bankruptcy. In exchange, the debtor must usually forfeit some personal property. A Chapter 7 bankruptcy remains on the debtors consumer credit report for 10 years.</p>
<p><b>Chapter 11 Bankruptcy:</b> Although Chapter 11 Bankruptcy is normally used for businesses, it can be used by consumers in specific rare cases involving extremely large debt. However, Chapter 7 and Chapter 13 can be much simpler and provide better protection for most consumers.</p>
<p><b>Chapter 13 Bankruptcy:</b> Chapter 13 is a type of consumer bankruptcy under which the debtor does not forfeit personal property. Rather, the consumer agrees to a three- to five-year wage earner plan to repay all or part of their debt. A Discharged Chapter 13 bankruptcy remains on a consumer credit report for 7 years from the date filed. An Open or Dismissed Chapter 13 bankruptcy remains on a consumer credit report for 10 years from the date filed.</p>
<p><b>Foreclosure:</b> The legal process by which a creditor may sell mortgaged property to recover a defaulted mortgage.</p>
<p><b>Judgment:</b> A determination by a court of law that, in the case of credit, may require a person to satisfy or pay a debt.</p>
<p><b>Tax Lien:</b> A charge upon real or personal property for the satisfaction of debts related to taxes.</p>
<p><b>Civil Lien:</b> A charge upon real or personal property for the satisfaction of some debt or duty ordinarily arising by operation of law.</p>
<p><b>Inquiry:</b> An instance in which all or part of your credit file is accessed by a company or individual. Inquiries stay on your consumer credit report for not more than two years.</p>

Lastly, the lowest form of consumer courts is the district level, which works in specific districts, and handling a maximum value of Rs. 20 lacs.</p>
